Terms of service
These terms and conditions apply to all quotes, proposals and orders of MR. Catering: catering, bar concepts, staff, rental of materials and complete event catering, for businesses and private individuals.
Article 1. Definitions
- MR. Catering: trade name of MR. Catering Events, a general partnership (vennootschap onder firma), Lübeck 5, 2993 LK Barendrecht, Dutch Chamber of Commerce (KvK) no. 92540201.
- Client: the company or person who places an order with MR. Catering.
- Consumer: a client who is not acting in the course of a profession or business.
- Event: the gathering for which MR. Catering supplies its services, such as a lunch, meeting, trade fair, company party, wedding, birthday or dinner.
- Proposal: MR. Catering’s quote setting out the agreed catering, numbers, times and prices.
- Materials: everything MR. Catering brings along or rents for the event, such as bars, coffee machines, crockery, glassware, standing tables, cooling units and tents.
Article 2. Applicability
These terms and conditions apply to every request, every proposal and every order. Deviations apply only if we have agreed them in writing (including by email). The client’s general terms and conditions do not apply.
Article 3. Price tool, proposals and prices
- The price in the price tool Calculate your price is an indication based on your choices. This does not yet create an order.
- Our proposals are without obligation and valid for 14 days, unless the proposal states otherwise. Until confirmation, the availability of staff and materials and the prices may still change.
- Prices for businesses are exclusive of VAT; prices for consumers are inclusive of VAT. The proposal states which VAT rates apply.
- The price is based on the details in the proposal: the number of guests, the date and times, the venue and the chosen catering. If those details change, the price may change.
- Surcharges apply for staff on Sundays and public holidays and for an event that ends after 23:00. For an order placed within 2 days before the event, we charge a short-notice surcharge. The surcharges are stated in the proposal.
- For on-site catering, we charge mileage and travel time, even for nearby venues. For delivery, we charge delivery costs; collection in Barendrecht is free of charge. Parking costs at the venue are payable by the client.
- A minimum order quantity applies to some products, as stated in the proposal or on the website.
Article 4. Conclusion of the order
The order is concluded as soon as the client has accepted the proposal in writing or by email and MR. Catering has confirmed the order. If a deposit has been agreed, we will definitively reserve staff and materials as soon as it has been received.
Article 5. Number of guests and changes
- The client must provide the final number of guests no later than 7 days before the event.
- We will process a higher number notified after that deadline if this is still possible; we will then charge for the higher number. A lower number notified after that deadline can no longer be deducted; we will then charge for the number previously provided.
- We are happy to process changes to the menu, times or set-up for as long as this is possible. Any additional costs will be communicated in advance.
- If the event lasts longer than agreed, we will charge for the additional time of our staff per half hour or part thereof, at the hourly rate stated in the proposal.
Article 6. The venue
- The client must ensure that we can access the venue at the agreed time, with a loading and unloading area nearby and a suitable space for setting up.
- The client must provide the facilities stated in the proposal, such as power connections and, where necessary, water. If these are lacking, we cannot deliver everything as agreed; in that case, the agreed price remains payable.
- The client must arrange the permission and permits required for the venue or the event.
- For an outdoor event, the client must provide a suitable covered area or rent a tent through us. In weather that is unsafe for guests, staff or materials, we may adjust the set-up or temporarily suspend the service.
Article 7. Performance
- We carry out the order with care, using skilled staff and in accordance with food safety regulations. We may engage regular partners and additional staff to carry out the order.
- We serve alcohol in accordance with the Dutch Alcohol Act. We do not serve alcohol to persons under the age of 18, and we may ask for proof of identity. We may refuse to serve guests who are under the influence.
- Our food and drink are prepared for consumption during the event. For food safety reasons, we do not give out leftovers to take away, unless we agree otherwise in advance.
- The client must appoint a contact person who can be reached on the day itself.
Article 8. Allergies and dietary requirements
- The client must inform us of guests’ allergies and dietary requirements no later than when providing the final number of guests.
- On request, we provide information about the allergens in our products. We work carefully, but various ingredients are processed in our kitchen and during set-up. We therefore cannot guarantee that products are completely free from traces of allergens.
- We are not liable for the consequences of allergies or dietary requirements that were not communicated to us, or not communicated in time.
Article 9. Materials and damage
- Materials remain the property of MR. Catering or of our rental partner.
- From delivery until collection, the client is responsible for the materials. We charge for loss, theft or damage not caused by our staff at replacement value or repair cost.
- Rented materials are delivered clean. Washing-up and cleaning are only included if this is stated in the proposal.
Article 10. Cancellation
- Cancellation is only possible in writing or by email. The date on which we receive the cancellation is decisive.
- In the event of cancellation by the client, we charge a portion of the agreed price:
- up to 30 days before the event: free of charge;
- from 30 to 14 days before the event: 25%;
- from 14 to 7 days before the event: 50%;
- from 7 to 2 days before the event: 75%;
- within 2 days before the event: 100%.
- We will always pass on costs that we have already incurred at the client’s request for special purchases, custom work or materials that we cannot cancel free of charge.
- A smaller event or fewer services after confirmation will be treated as a partial cancellation in respect of the difference.
Article 11. Payment
- Businesses must pay within 14 days of the invoice date. For large events, we may request a deposit; this will then be stated in the proposal.
- Consumers must pay a deposit of 50% upon confirmation of the order. They must pay the balance no later than 7 days before the event, unless otherwise agreed. Costs for extra time or extra guests on the day itself are invoiced afterwards.
- If the client does not pay on time, we will send a reminder. If payment is still not made after that, statutory interest and collection costs are payable in accordance with the law. A consumer will first receive a formal demand for payment, free of charge, with a payment period of 14 days.
Article 12. Complaints
- If something is not in order, report it immediately to our staff on site so that we can resolve it straight away.
- Complaints that could not be resolved on the spot must be reported by the client by email to info@mrcatering.nl within 2 working days after the event, with a clear description. We will respond within 5 working days.
- A complaint does not confer a right to suspend payment. For consumers, the statutory rules apply in this respect.
Article 13. Liability
- If MR. Catering is liable, that liability is limited to the invoice amount of the order or, if higher, to the amount paid out by our insurance in the case concerned.
- We are not liable for indirect loss, such as consequential loss, loss of revenue or loss caused by the delay of an event, nor for damage to or caused by property of the client or guests.
- These limitations do not apply in the event of intent or deliberate recklessness on the part of MR. Catering, or where the law does not permit them.
Article 14. Force majeure
In the event of force majeure, such as extreme weather, illness of staff for whom no replacement can be found, transport or energy disruptions, or government measures, we will do everything we can to ensure the event still goes ahead, for example with replacement staff or materials. If this is not possible, either party may (partially) terminate the order. We will refund any amount already paid for parts that we have not delivered.
Article 15. No right of withdrawal for consumers
By law, an order for catering on a specific date is exempt from the right of withdrawal (the statutory cooling-off period of 14 days). The rules of Article 10 apply to cancellation.
Article 16. Photos
At events, we sometimes photograph our own set-up, products and team, for example for our website and social media. We do not publish, without consent, images in which guests are recognisable. If the client does not want us to take photos, they must let us know in advance.
Article 17. Privacy
How we handle personal data is set out in our privacy policy.
Article 18. Applicable law and disputes
All orders are governed by Dutch law. If we cannot resolve a dispute together, the most diligent party will submit the dispute to the competent judge of the District Court of Rotterdam. A consumer may, within one month after we have invoked this provision, choose the court that has jurisdiction under the law.
